1. What is the Data Privacy Act?

 The Data Privacy Act was enacted by the government to protect an individual’s personal information.

2. What is Personal Information?

Personal information refers to any data that would directly and certainly identify an individual (e.g. Full Name, Address, Contact Number).

3. What is sensitive Personal Information?

Sensitive personal information refers to personal information about an individual’s race, ethnic origin, marital status, age and color; religious, philosophical or political affiliations; health, education, genetic or sexual life; proceedings for committed or alleged offenses; issued by government agencies that are peculiar to an individual; and specifically established by an executive order or an act of Congress to be kept classified.

4. What is processing of personal data?

Processing refers to any operation or any set of operations performed on personal information: collection, recording, organization, storage, updating, retrieval, use, consolidation, blocking or destruction of data, through automated means or manual processing.

5. What are your rights as a Data Subject?

        The Data Privacy Act provides the following rights in relation to your personal data:

  • Right to be informed of the processing of your personal information.
  • Right to object to the processing of your personal information.
  • Right to access the content of any information relating to you on computer database and/or manual filing system in an easy-to-access format, accompanied with a full explanation executed in plain language.
  • Right to correct any error in your personal information.
  • Right to block/remove your personal information from CLIMBS records.
  • Right to data portability or to obtain a copy of the data being processed in an electronic or structured format.
  • Right to be indemnified for damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained, or unauthorized use of your personal information.
  • Right to file complaints for violations of the Act, its implementing rules, and your rights as data subject.

6. What is a Consent Form?

The Consent Form manifests your consent for CLIMBS to process and disclose your personal information in connection with the purposes indicated therein, the entities to which your personal information will be disclosed and the effectivity of such consent.

7. How do I give my Consent?

All new business application forms will be accompanied by Data Privacy consent form. For existing clients, a letter or notice from CLIMBS will be sent to them via email or registered mailing address.

8. Why is it significant to provide Consent?

  • The consent is required so that CLIMBS may be able to process policy-related services, such as Underwriting, Benefits pay-out, Claims, etc.
  • Consent is given to allow CLIMBS to disclose information to employees, subsidiaries and/or third parties who are / will be doing related policy-related services or functions of the company.
  • Consent is obtained to upload client health condition in the Medical Information Database (as required by Insurance Commission) accessible to all insurance companies for the sole purpose of fraud prevention.
  • Consent to allow CLIMBS to retain client record for a period of 10 years after termination of contract.

9. What happens if you do not provide your consent to CLIMBS?

CLIMBS may not be able to administer the products and services that you availed of, or implement transactions, order and instructions in connection with such products and services, and manage your account/s in general.

10. How will CLIMBS secure my personal information?

CLIMBS has implemented appropriate organizational, physical and technical security measures to ensure the protection of your personal information.

11. Will CLIMBS provide personal information to third parties?

CLIMBS may provide personal information to its agents and third party service providers to perform certain functions relative to the products and services availed of and for general administration of your account/s.

CLIMBS shall ensure that its agents and third party service providers have in place appropriate organizational, physical and technical security measures for the protection of your personal information.

12. How long will CLIMBS keep my personal information?

CLIMBS will retain client record for a period of 10 years after termination of contract or until required by law and regulation, or by circumstances requiring such retention.
